OPPO successfully invalidates VoiceAge EVS patent

According to the latest report, the standard essential patent of NPE VoiceAge EVS, which is almost invincible on the German “battlefield”, was declared invalid for the first time, and the invalid petitioners included OPPO and HMD. Before this, VoiceAge EVS actually had a big chance of winning, because the German Federal Patent Court’s preliminary opinion was to keep its patent valid, and now the case has ushered in a reversal.

It is reported that the invalidated patent EP3132443 involves “methods, encoders, and decoders for linear predictive coding and decoding of sound signals”, and all invalid requests made by OPPO have been supported. This time OPPO successfully invalidated the VoiceAge EVS patent is undoubted of great significance. For OPPO, there is no need to worry about the ban risk brought by the EP3132443 patent.

Just a few weeks ago, under the pressure of the German ban, Xiaomi signed a patent license agreement with VoiceAge EVS, and the patent litigation case ended in the withdrawal of VoiceAge EVS. According to public information, VoiceAge EVS was established on November 27, 2018, and is a subsidiary of Fortress Investment Group acquired by SoftBank.

After its establishment, VoiceAge, one of the major contributors to EVS codec technology, announced a strategic transaction with Fortress Investment Group, transferring the EVS patent portfolio to VoiceAge EVS. Compared to other codecs, EVS offers a wider frequency range, higher compression rates, and other features, and is supported by most of the world’s major operators and equipment manufacturers.

The EVS patent has also become a “powerful weapon” for VoiceAge EVS to frequently file patent infringement lawsuits against smartphone manufacturers such as OPPO, TCL, Xiaomi, and HMD. Germany, the United States, and other countries have also become the company’s main battlefield.

Analyzing the litigation cases of HD codec technology companies, it can be found that the EVS patent of VoiceAge EVS is in line with the standard formulation, and has strong stability, so it is difficult to be invalidated. VoiceAge EVS was almost never defeated in Germany until the German Federal Patent Court made its invalidation decision.

In August 2021, the Munich District Court ruled that HMD infringed the EP2707687 patent held by VoiceAge EVS and issued a sales ban. Manufacturers such as Xiaomi chose to reach a settlement with the company.
