Ministry of Human Resources and Social Security: Online recruitment must not charge workers deposits

The Ministry of Human Resources and Social Affairs has issued the ‘Regulations on the Management of Online Recruitment Services’, which will be implemented on March 1, 2021.

The regulations point out that operational human resource service agencies shall not collect deposits from workers.

The ‘Regulations on the Management of Online Recruitment Services’ is the first departmental regulation in the field of online recruitment services in my country, which stipulates the access, service standards, supervision and management, and legal responsibilities of online recruitment services.

The ‘Regulations’ clarify that for business human resource service agencies to engage in online recruitment services, they should obtain a human resource service license in accordance with the law, and those involved in operating telecommunications services should also obtain a telecommunications business license, and continue to publicize their business licenses and human resources service licenses.

And other information. The ‘Regulations’ regulate online recruitment information review, information protection, fee management, and other service matters, and specify that human resource service agencies engaged in online recruitment services should establish a complete online recruitment information management system to provide employers with authenticity and legality in accordance with the law.

It must not disclose, tamper with, damage, or illegally sell or illegally present to others the personal data it collects and the operating status of the employer.

The operational human resource service organization shall not collect deposits from employees, and shall clearly indicate its service items, Matters such as charging standards.

Additionally, the ‘Regulations’ also clarified management measures such as supervision and inspection, integrity building, annual reports, and information sharing.
